TERMS AND CONDITIONS

Please READ carefully, as this pertains to the Agreement of your donation and engagement in any of our offerings which you privately contracted for through your donation, reviewing, consenting to and digitally autographing the Private Members Agreement, and joining the Superpowered Self-healing Private Membership Club.

By donating for any of our offerings, you (sometimes referred to as "Patron") agree to the following terms stated.

‍This website (the "Site") is owned and operated by Polla Pratt (“COMPANY” "we" or "us"). By using the Site, you agree to be bound by these Terms of Service and to use the Site in accordance with these Terms of Service, our Privacy Policy, our Shipping Policy, our Return Policy and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from COMPANY. Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service.

We reserve the right to change these Terms of Service or to impose new conditions on use of the Site, from time to time, in which case we will post the revised Terms of Service on this website. By continuing to use the Site after we post any such changes, you accept the Terms of Service, as modified.

CLASS OFFERING

The Superpowered Self-healing Club (a private club outside of Public Legal Jurisdictions) agrees to provide content, identified as an online course aid, and live interactive online private classes to help members learn how to take full self-responsibility to heal themselves and loved ones. Members agree to abide by all policies and procedures outlined in this Agreement (and in the Private Membership Agreement) as a condition of their participation in any of our programs. Patrons/Members agree that all offerings of the Superpowered Self-healing Club are for private, personal, in-home use only and that they will not use the any of the material or learnings in any of our programs in a professional for profit capacity in public jurisdictions—all courses and offerings are for private individuals use only, in the privacy of their own home, and Members agree to not use in any professional capacity.

DISCLAIMER

Patron/Donor understands Polla Pratt and the Superpowered Self-healing Club is not an employee, agent, lawyer, doctor, manager, therapist, public relations or business manager, registered dietician, or financial analyst, psychotherapist or accountant.

Patron understands their participation in this program will not treat or diagnose any disease, illness, or ailment and if they should experience any such issues they should see their registered physician or other practitioner as determined by their own judgment.

FINANCIAL OBLIGATION

Client is responsible for the completion of all donation plans associated with offerings they may have chosen. We reserve the right to seek recovery of any monies remaining via our Collection Agency.

METHODS OF DONATIONS

Superpowered Self-healing Club accepts personal check, postal money orders, Zelle, Visa, Mastercard, American Express, and PayPal as a form of donation. If Patron chooses to donate by monthly installments, he/she authorizes the monthly withdrawal for the offering on the Members’s credit card or debit card.

CONFIDENTIALITY

Superpowered Self-healing Club respects Members’ privacy and insists that the Member respects ours as well. Thus, consider this a mutual non-disclosure Agreement. Any confidential information shared by Superpowered Self-healing Club Member participants or any representative of Superpowered Self-healing Club is confidential, proprietary, and belongs solely and exclusively to the Member or representative who discloses it. Parties agree not to disclose, reveal, or make use of any confidential information or any transactions during discussions, in the forum or otherwise.

Member agrees not to use such confidential information in any manner other than in discussion with other Members, or with Polla, Melissa, or Marizelle, during the respective program offering and or after at any time. Confidential information includes, but is not limited to, information disclosed in connection with this Agreement and The Private Membership Agreement, and shall not include information rightfully obtained from a third party.

Both Parties will keep private information in strictest confidence and shall use their best efforts to safeguard the confidential information and to protect it against disclosure, misuse, espionage, loss, and theft.

Member agrees not to violate the Publicity or Privacy Rights belonging to Superpowered Self-healing Club. Furthermore, Member will NOT reveal any information to a third party obtained in connection with this Agreement or our direct or indirect dealings with Member, including but not limited to, names, email addresses, third-party company titles or positions, phone numbers, or postal addresses. Additionally, Member will not, at any time, either directly or indirectly, disclose confidential information to any third party.

By donating through non-commercial private exchange for our offerings, you agree that if you violate or display any likelihood of violating this Agreement, Superpowered Self-healing Club can take action through Private Arbitration as agreed upon in the Private Members Agreement, and that Member’s membership and continued participation may be terminated without reimbursement of any donation made.

RESPONSIBILITY

Offerings developed by Superpowered Self-healing Club are private, are non-commercial and are strictly for educational purposes ONLY. Member accepts and agrees that Member is 100% responsible for their progress and results from offerings developed by Superpowered Self-healing Club. Superpowered Self-healing Club makes no representations, warranties, or guarantees verbally or in writing. Members understand that because of the nature of offerings developed by Superpowered Self-healing Club and their extent, the results experienced by each Member may significantly vary. Member acknowledges that, as with any self-healing endeavor, there is no guarantee that Member will reach their goals as a result of participation in offerings developed by Superpowered Self-healing Club or through their own private use of any Home Ozone systems they may choose to purchase and or engage with. Superpowered Self-healing Club program education and information is private and non-commercial in nature and is intended for a general audience and does not purport to be, nor should it be construed as, specific advice tailored to any individual. Superpowered Self-healing Club assumes no responsibility for errors or omissions that may appear in any offering materials.

MISCELLANEOUS

LIMITATION OF LIABILITY

Member agrees they to use Superpowered Self-healing Club offerings at their own risk and that Offering is only an educational offering being provided. Member releases Superpowered Self-healing Club, its trustees, officers, directors, subsidiaries, principals, agents, heirs, executors, administrators, successors, assigns, Instructors, guides, Participants, in all ways as well as the venue where the offerings are being held (if applicable) and any of its owners, executives, agents, or staff (sometimes referred to as “Releasees”) from any and all damages that may result from any claims arising from any Agreements, all actions, causes of action, contracts, claims, costs, demands and damages of whatever nature or kind arising from members’ participation in the offerings. Member accepts any and all risks, foreseeable or unforeseeable. Member agrees that Superpowered Self-healing Club will not be held liable for any damages of any kind resulting or arising from including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of Superpowered Self-healing Club’s offering or enrollment in any offering, or use of any equipment Member may choose to use in conjunction with Offering. Superpowered Self-healing Club assumes no responsibility for errors or omissions that may appear in any of the program materials.

NON-DISPARAGEMENT

The Parties agree and accept that the only venue for resolving any such dispute shall be in the venue set forth herein below and in The Private Membership Agreement. The Parties agree that they neither will engage in any conduct or communications with a third party, public or private, designed to disparage the other. Neither Member nor any of Members’s associates, employees or affiliates will directly or indirectly, in any capacity or manner, make, express, transmit speak, write, verbalize or otherwise communicate in any way (or cause, further, assist, solicit, encourage, support or participate in any of the foregoing), any remark, comment, message, information, declaration, communication or other statement of any kind, whether verbal, in writing, electronically transferred or otherwise, that might reasonably be construed to be derogatory or critical of, or negative toward, the Superpowered Self-healing Club or any of its programs, members, trustees, directors, officers, affiliates, or subsidiaries

INDEMNIFICATION

Members shall defend, indemnify, and hold harmless the Superpowered Self-healing Club’s officers, contractors, directors, any related entities, trustees, affiliates, and successors from and against any and all liabilities and expense whatsoever – including without limitation, claims, damages, judgments, awards, settlements, investigations, costs, private arbitration fees, and disbursements – which any of them may incur or become obligated to pay arising out of or resulting from their participation in the offering, and/or use of any Ozone system and or related products that Member may choose to use in combination with offering, excluding, however, any such expenses and liabilities which may result from a breach of this Agreement or sole intentional negligence or harm or willful misconduct by Superpowered Self-healing Club, or any of its trustees, affiliates or successors. Member understands and agrees to the Private Members Agreement and takes full self-responsibility for all their thoughts, actions, words and any and all consequences arising from such and all is in private jurisdiction and not public in any shape or form (see Private Members Agreement).

Member recognizes and agrees that all of the Superpowered Self-healing Club’s, trustees, affiliates and successors shall not be held personally responsible or liable for any actions or representations of the Superpowered Self-healing Club. In consideration of and as part of Members’s donation in private non-commercial exchange for the right to participate in Superpowered Self-healing Club’s offerings, the undersigned, your heirs, executors, administrators, successors and assigns do hereby release, waive, acquit, discharge, indemnify, defend, hold harmless and forever discharge Superpowered Self-healing Club and its trustees, subsidiaries, principals, directors, heirs, executors, administrators, successors, and assigns and any of the instructors, guides, helpers or students taking part in the training in any way as well as the venue where the offerings are being held (if applicable) and any of its owners, executives, agents, or staff (sometimes referred to as “Releasees”) of and from all actions, causes of action, private contracts, claims, costs, demands and damages of whatever nature or kind arising from my participation in the offerings.

NO TRANSFER OF INTELLECTUAL PROPERTY

Superpowered Self-healing Club’s Offerings are copyrighted and original materials that have been provided to Members and are for Members individual private non-commercial use only and is ONLY a single-user license. Members are not authorized to share any of Superpowered Self-healing Club’s intellectual property or that of any of its Trustees, guides or Beneficiaries. All intellectual property, including Superpowered Self-healing Club’s copyrighted program and/or course materials, shall remain the sole property of the Polla Pratt and Superpowered Self-healing Club. No license to sell or distribute Superpowered Self-healing Club’s materials is granted or implied. By donating and accepting any offers, Member agrees (1) not to infringe any copyright, patent, trademark, trade secret, or other intellectual property rights, (2) that any Confidential Information shared by the Superpowered Self-healing Club is confidential and proprietary, and belongs solely and exclusively to the Superpowered Self-healing Club, (3) Member agrees not to disclose such information to any other person or use it in any manner other than in discussion within the Superpowered Self-healing Club.

FORCE MAJEURE

In the event that any cause beyond the reasonable control of either Party, including without limitation acts of God, war, curtailment or interruption of transportation facilities, threats or acts of terrorism, State Department travel advisory, labor strike or civil disturbance, make it inadvisable, illegal, or impossible, either because of unreasonable increased costs or risk of injury, for either party to perform its obligations under this Agreement, the Superpowered Self-healing Club’s performance shall be extended without liability for the period of delay or inability to perform due to such occurrence.

SEVERABILITY/WAIVER

If any provision of this Agreement is held by to be invalid or unenforceable, the remaining provisions shall nevertheless continue in full force. The failure of either Party to exercise any right provided for herein will not be deemed a waiver of that right or any further rights hereunder.

MODIFICATION

Superpowered Self-healing Club may modify terms of this Agreement at any time. All modifications shall be posted on the Program’s website and members shall be notified.

SELF-HEALING DISCLAIMER:

EVERY EFFORT HAS BEEN MADE TO ACCURATELY REPRESENT OUR OFFERINGS AND THEIR POTENTIAL. THERE IS NO GUARANTEE THAT YOU WILL HEAL YOURSELF.

ANY CLAIMS MADE OF ACTUAL SELF-HEALING THROUGH MEMBER TESTIMONIALS OF ACTUAL RESULTS CAN BE VERIFIED UPON REQUEST. YOUR LEVEL OF SUCCESS IN ATTAINING THE RESULTS CLAIMED IN OUR MATERIALS DEPENDS ON MANY FACTORS INCLUDING YOUR THOUGHTS, EMOTIONS, ATTITUDES, BELIEFS, LEVEL OF STORED TRAUMA IN YOUR BODY, YOUR ABILITY TO LOVE YOURSELF, YOUR LEVEL OF COMMITMENT AND FOLLOW THROUGH IN YOUR OWN SELF-HEALING, THE AMOUNT OF TIME AND ENERGY YOU PUT INTO YOUR SELF-HEALING. WE CANNOT GUARANTEE YOUR SUCCESSFUL SELF-HEALING, NOR ARE WE RESPONSIBLE FOR ANY OF YOUR ACTIONS.

MANY FACTORS ARE IMPORTANT IN DETERMINING YOUR ACTUAL RESULTS AND NO GUARANTEES ARE MADE THAT YOU WILL ACHIEVE RESULTS SIMILAR TO OURS OR THE TESTIMONIALS OF OUR MEMBERS. IN FACT, NO GUARANTEES ARE MADE THAT YOU WILL ACHIEVE ANY RESULTS FROM THE IDEAS AND TECHNIQUES IN OUR MATERIAL.
